21 sentenced in municipal court

WILMINGTON — The following report is compiled using a disposition report provided by Clinton County Municipal Court. The information includes the defendant’s name, age, residence if listed, charge(s) disposed, fine, court costs assessed, jail sentence and any special conditions. Municipal Judge Mike Daugherty oversees the court, which administers the law in criminal misdemeanor cases.

The following pled guilty or were found guilty of crimes between Nov. 28 and Dec. 2:

• Lewis Brown Feliciano, 32, of Columbus, receiving stolen property, sentenced to 30 days in jail (suspended), fined $250, assessed $125 court costs. The charge was amended from a felony level 4 receiving stolen property charge, stayed until issue of restitution is resolved at sentence review, waiver of preliminary hearing/entry accepting waiver. A charge of drug paraphernalia was dismissed.

• Christian Foreman, 19, of Blanchester, aggressive trespassing, disorderly conduct, sentenced to 30 days in jail (suspended), fined $275, assessed $250 court costs. Foreman must have no contact with victims for two years; the charge was amended from level felony 3 burglary, must complete SAQ and follow up with recommendations.

• David Sannan, 44, of Wilmington, domestic violence, sentenced to 30 days in jail (suspended), fined $100, assessed $125 court costs. Must take part in supervised probation.

• Jesse Jones, 34, of Leesburg, violating protection order, sentenced to 30 days in jail (suspended), fined $150, assessed $125 court costs. The charge was amended from misdemeanor 1 violate protection order/no contact, he must commence offense for one year and perform non-reporting probation. A charge of resisting arrest was dismissed.

• Jacob Boldman, 19, of New Vienna, reckless operation, sentenced to 60 days in jail, fined $250, assessed $125 court costs. The charge was amended from misdemeanor 1 O.V.I., ALS vacated. An additional charge of O.V.I. was dismissed.

• Shannon Allphin, 40, of Wilmington, theft, trespassing, sentenced to 120 days in jail (suspended), fined $1,500, assessed $250 court costs. Allphin must take part in supervised probation, have no contact with the business, and write a letter of apology to victim.

• Derrick Thomas, 26, of Dayton, telecommunication harassment, sentenced to 30 days in jail (suspended), fined $150, assessed $125 court costs. Thomas must have no contact with the victim, must commit no further criminal offenses for one year.

• Misty Collins, 37, of Wilmington, unauthorized use of property, sentenced to 30 days in jail, fined $250, assessed $125 court costs. The charge was amended from misdemeanor 1 complicity petty theft, the jail stayed defendant to complete diversion.

• Timothy Baker, 50, of Clarksville, driving under suspension, sentenced to 30 days in jail, fined $200, assessed $125 court costs. Additional charges of no operator’s license, and highway traffic signal indications were dismissed.

• Aubree Edwards, 19, of Wilmington, hit skip, sentenced to 90 days in jail (suspended), fined $250, assessed $125 court costs, operator’s license suspended from Dec. 2, 2016 to May 31, 2017. Edwards must perform six months of non-reporting probation.

• Cyntia Flynn, 21, of Fairfield, disorderly conduct, sentenced to 10 days in jail (7 days suspended), fined $1,000, assessed $125 court costs. The charge was amended from misdemeanor 1 assault. Flynn must not have contact with the victim. An additional charge of domestic violence was dismissed.

• John Barnthouse, 39, of Lebanon, possession of drug instruments, sentenced to 90 days in jail (suspended), assessed $125 court costs. Barnthouse must take part in 12 months of non-reporting probation.

• Kourtney Spurling, 26, of Sabina, domestic violence. If the complaint takes part in 20 weeks domestic violence awareness class, the court will dismiss.

• Dustin Routt, 32, of Midland, theft, assessed $125 court costs. Routt must pay $1,000 restitution to victim.

• John Cox, 61, of Wilmington, operation in willful or wanton disregard of safety of persons or property, sentenced to 90 days in jail (suspended), fined $250, assessed $125 court costs. The charge was amended from misdemeanor 1 O.V.I., must follow-up with solutions, ALS vacated.

• James Kelly, 26, of Wilmington, reckless operation, sentenced to 60 days in jail, fined $250, assessed $125 court costs. The charge was amended from misdemeanor 1 O.V.I., must commit no similar offenses within two years, ALS vacated. An additional charge of tag/sticker violation was dismissed.

• Kelby Gilkey, 20, of Wilmington, hit-skip private property, sentenced 30 days in jail (suspended), fined $100, assessed $125 court costs. The charge was amended from misdemeanor hit skip, the defendant shall commit no offenses for a period of two years and non-reporting probation.

• James Funk, 21, of Wilmington, possession of controlled substances, fined $100, assessed $125 court costs.

• T.J. Harris, 23, of Wilmington, drug paraphernalia, possession of marijuana, fined $100, assessed $250 court costs.

• Michael McQuade, 41, of Washington Court House, driving under suspension, fined $200, assessed $125 court costs.

• Matthew Sims, 40, of Arlington, going 94 in a 65 mph speed zone, fined $105, assessed $125 court costs. The case was waived by defendant.
